Recourse

If you are dissatisfied with this Web site or with any of the terms and conditions contained in this Copyright and Terms of Use agreement, your sole and exclusive remedy is to discontinue using this Web site. ODSC is committed to maintaining the security, confidentiality and privacy of personal information under its control. This Privacy Policy documents the commitment of ODSC and has been developed in compliance with the British Columbia Personal Information Protection Act.

 

Definitions

 

“Collection” means the act of gathering, acquiring or obtaining personal information from any source, including third parties, by any means.

 

“Consent” means voluntary agreement to the collection, use and disclosure of personal information for specified purposes. Express consent is unequivocal and can be given orally, electronically or in writing. Implied consent can be reasonably inferred from an individual’s action or inaction.

 

“Disclosure” means making personal information available to a third party.

 

“Personal information” means information about an identifiable individual. It does not include

(1) business contact information about an individual,

(2) information that cannot be associated with a specific individual,

(3) publicly available information recognized under PIPA, or

(4) information about corporate or commercial entities.

 

“PIPA” means the British Columbia Personal Information Protection Act S.B.C. 2003, c.63.

 

“Third party” means an individual or organisation other than ODSC or you.

 


The Ten Privacy Principles

 

 Principle 1 – Accountability

 ODSC is accountable and responsible for personal information under its control. ODSC has designated a Privacy Officer who is accountable for the day-to-day compliance of ODSC with this Policy and who can be contacted as set out at the end of this Policy.

 Other individuals within ODSC may be accountable for the day-to-day collection and processing of information or to act on behalf of the Privacy Officer.

Ultimate accountability for compliance by ODSC with this Policy lies with the ODSC Board of Directors.

 ODSC has established policies and procedures to protect personal information, to receive and respond to complaints and inquiries, to train staff regarding policies and procedures and to communicate policies and procedures to you on request.

 

Principle 2 – Purposes

 

ODSC will identify the purposes for collecting the personal information prior to or at the time it is being provided.

 

ODSC will ensure that the purposes for collecting the personal information are what a reasonable person would consider appropriate in the circumstances.

 

ODSC will collect only the personal information that is reasonably necessary to fulfill the purposes identified.

 

Personal information will not be used for a purpose not previously identified without further individual consent, unless the new purpose is authorized or required by PIPA or other law.

 

Principle 3 – Consent

 

ODSC will obtain an individual’s consent to collect, use or disclose personal information except where ODSC is authorized or required by PIPA or other law to do so without consent. For example, ODSC may collect, use or disclose personal information without an individual’s knowledge or consent where

 

(1) ODSC is obtaining legal advice,

(2) ODSC reasonably expects that obtaining consent would compromise an investigation or proceeding, or

(3) ODSC is obtaining personal information under circumstances where an individual is seriously ill or mentally incapacitated.

 

Consent can be withdrawn at any time, subject to legal or contractual restrictions, provided that reasonable notice of withdrawal of consent is given to ODSC. On receipt of notice of withdrawal of consent, ODSC will inform the individual of the likely consequences of withdrawal of consent, which may include the inability of ODSC to provide certain products or services for which that information is necessary.

 

Principle 4 – Limits on Collection of Personal Information

 

ODSC will limit collection of personal information to that which is reasonable and necessary in the circumstances and which is reasonable and necessary for the purposes consented to by an individual. ODSC may also collect information as authorized by PIPA or other law.

 

Principle 5 – Limits on Using, Disclosing and Retaining Personal Information

 

ODSC will not use or disclose personal information for purposes other than those for which it was collected, except with the consent of the individual or as required or authorized by PIPA or other law.

 

ODSC will keep personal information used to make a decision affecting an individual for at least one year after using it to make the decision.

 

ODSC will destroy, erase or make anonymous documents or other records containing personal information as soon as it is reasonable to assume that the original purpose is no longer being served by retention of the information and retention is no longer necessary for legal or business purposes.

 

Principle 6 – Accuracy

 

ODSC will make a reasonable effort to ensure that personal information is accurate, complete and up-to-date as necessary for the purposes for which it is to be used. However, ODSC necessarily relies on the individual to ensure that certain information, such as an address or telephone number, is accurate, complete and current.

 

Principle 7 – Safeguarding Personal Information

 

ODSC protects the personal information in its custody or control by making reasonable security arrangements appropriate to the sensitivity of the information to prevent unauthorized access, collection, use, disclosure, copying, modification, disposal or similar risks. Some specific safeguards include

(1) physical measures such as locking filing cabinets,

(2) organisational measures such as restricting employee (including volunteer) access to files and databases as appropriate, and

(3) electronic measures such as passwords and firewalls.

 

Confidentiality and security are not assured when information is transmitted through

e-mail or other wireless communication. ODSC cannot and will not be responsible for any loss or damage suffered as a result of breach of security and/or confidentiality when information is transmitted to ODSC by e-mail or other wireless communication or when ODSC transmits such information by such means at your request or with your consent.

  Principle 8 – Openness

ODSC will make specific information about its personal information policies and practices available to individuals upon request.

 
Principle 9 – Providing Access

 Upon request and authentication identity, ODSC will inform individuals of the existence, use and disclosure of their personal information and provide reasonable access to that information. ODSC will make the information available within 30 days or provide written notice when additional time is required to fulfil the request.

ODSC will correct personal information that ODSC verifies is inaccurate or incomplete. If no correction is made, ODSC will make a note on the file stating that a correction was requested but not made and setting out the details of the request. When appropriate, ODSC will send a copy of the corrected personal information to a third party to whom the uncorrected information was disclosed.  

 

ODSC may not be able to provide access to certain personal information. For example, this may be the case when

(1) access would reveal personal information about another individual,

(2) the information is protected by solicitor/client privilege,

(3) the information was collected for the purposes of an investigation,

(4) disclosure of the information would reveal confidential commercial information that, if disclosed, could harm the competitive position of ODSC, or

(5) ODSC is prevented by law from providing access.

 

When an access request is refused, ODSC will notify you in writing, providing reasons for the refusal and outlining the further steps available to you.

 Principal 10 – Compliance

 ODSC will provide procedures to investigate and respond to inquiries or complaints about the handling of personal information and compliance with this privacy policy. If a complaint is found to be justified, ODSC will take reasonable and appropriate measures to resolve it. Any inquiries or complaints should be directed in writing to the ODSC Privacy Officer.
